1510.015.35  Sanctions

  1. If an applicant who is required to register for work or to accept employment, training, or language training as outlined above has voluntarily quit employment for the purpose of receiving assistance, or refused to register, or refused to apply for or accept an appropriate offer of employment, within the 30 day period immediately prior to approval, the applicant is ineligible for cash, but is eligible for Refugee Medical Assistance if all other eligibility factors are met.  Other members of the household may apply for and receive cash assistance.
  2. If a recipient who is required to register for work or to accept employment, training, or language training, as outlined above refuses to register, or to accept or continue appropriate employment, training, or language training, discontinue cash assistance for the refugee for:
    1. three payment-months for the first such occurrence, and
    2. six payment-months for the second and subsequent occurrences.

    The refugee is eligible for Refugee Medical Assistance, if all other eligibility factors are met.

  3. For both applicants and recipient:
    1. Do not count the individual being sanctioned as a member of the cash assistance group in determining the amount of the standard.

      If the person being sanctioned is under age 21, only that income that the person actually makes available to the household is counted as income to the household.

      If the person being sanctioned is age 21 or over, count the person's gross income as income to the household.  The individual qualifies for any overhead expenses, the standard work expense of $90 and child care expenses as paid up, to the maximum of $200 or $175.

      If the person being sanctioned is the payee, pay assistance for the remaining members of the assistance unit in the form of protective payments, either by alternate payee or by orders.

    2. Notify the refugee's sponsor, or the voluntary resettlement agency where there is not a sponsor, of the action taken.
