0295.015.00  Good Cause For Job Refusal Or Job Quit

Use the following guidelines to determine if a claimant terminated or refused to accept employment or reduced earned income with good cause. The work may be temporary, permanent, full-time, part-time, or seasonal.

  1. The wage does not meet the federal or state minimum wage, whichever is applicable, or the wage is substantially less than the wage normally paid for similar work in that labor market.
  2. Daily and weekly hours of work exceed those customary to the occupation.
  3. The employment or offer of employment requires travel to and from the place of employment and the participant's home in excess of a total of two hours in round trip time, inclusive of the time necessary to transport family members to a school or place providing child care, or when walking is the only available means of transportation, the round trip is more than four miles.
  4. The participant is referred for direct job placement and there are three or fewer employers participating in the direct placement program which are available to the participant.
  5. The participant does not have a way to and from the job.
  6. The position offered is vacant because of a strike, lockout, or other bona fide labor dispute;
  7. The individual is required to work for an employer contrary to the conditions of his/her existing membership in the union governing that occupation (employment not governed by the rules of a union in which he/she has membership may be deemed appropriate).
  8. The work site is in violation of applicable federal, state, or local health and safety standards.
  9. The work adversely affects the individual's physical or mental health.  The individual must substantiate any claim of this nature by adequate medical statements.
  10. The individual is not physically able to engage in such employment.
